Re: Insurance Requirement by Florida Statue / Monthly Maintenance Fee / Fining Committee

To All Unit Owners:

Enclosed below is a brief summary of the new Florida Statue Insurance Requirement. Your financial obligation to obtain the proper policy described is required under the new law and The Towers Condominium Association Board of Directors through Alliant Property Management will request a copy from you for proof of compliance in the near future.

Unit Owner Insurance Responsibility. Unit owner coverage is still mandated by the state, but the statute will also require individual unit owner policies to provide $2,000.00 of loss assessment coverage per occurrence. The unit owner is required to provide proof of hazard and liability insurance upon request, but not more than once per year. The new statute also requires that the Association be named as an additional insured and loss payee on all casualty policies issued to unit owners. The new statute also provides that all improvements or additions to the Condominium Property that benefit fewer than all owners must be insured by the unit owners having the use thereof or may be insured by the Association at the cost and expense of the owners having the use thereof. This provision is subject to interpretation and could be interpreted to apply to limited common element, parking spaces, storage lockers, and even balconies and patios. The intent of this provision was to require owners to insure additions to the condominium property benefiting fewer than all unit owners that were not part of the original construction.

On October 30th, 2008 The Towers Condominium Association Board of Directors approved the budget for the monthly maintenance fee of $265.00 per month due and payable beginning January 1, 2009. You will receive the monthly coupon book from Colonial Bank in December and an up to date statement from Alliant Property Management reflecting your actual balance. Remit any balance due as soon as possible. The Board last year passed a motion, which stipulates that, any unit owner that is $400.00 delinquent, would be place relative to payment of monthly maintenance fees for collections with our Board Attorney. In addition the motion stipulated that any unit owner who is renting their unit and is placed for collections would lose their privilege to rent their unit in the future. If you need to obtain a book, contact Joan Molnar at Alliant Property Management. In addition approved is a fining committee consisting of volunteers from the Members of the Association to assist in enforcing compliance through a hearing with our deed restricted governing documents.

Part 2 of the ENFORCEMENT OF RULES AND REGULATIONS under section 2.1 and 2.2 states:

The Board of Directors has the authority and responsibility to enforce the rules and regulations of the Association. The standard fine is $100.00 for a single infraction of the rules and regulations. Florida Statute 718.303 limits an individual fine to $100.00. However, a fine may be levied on the basis of each day of a continuing violation, with a single notice and opportunity for hearing, up to a maximum of $1,000.00.

In order to protect the aesthetic and financial value as well as the overall safety of your home and community, please accept this letter as a friendly notice. The Association has the responsibility of enforcing the rules spelled out in the documents. Your neighbors have a right to expect that we will enforce the rules for them. We appreciate that not everyone may find the rules of interest or importance; nonetheless we must ask everyone to comply.

Please be aware of the fact that any and all questions from owners and tenants relative to the operation of The Towers Condominium Association should be directed to Derek Miller our CAM at Alliant Property Management. Any questions for rental inquiries should be directed to Kirsten Cantello or Terry Ondak and if you have any billing questions please direct them to Colin Jenkins.
